Toshiba, the authorized licensor for DVD6C, wins arbitration award to collect royalties due from DVD6C patent licensee

October 13，2011 --- The DVD6C Licensing Group (“DVD6C”) -- consisting of nine leading developers of DVD technology -- today announced that their authorized licensor, Toshiba Corporation, won an arbitration to collect royalties due from Coby Electronics Co., Ltd (“Coby”), a Chinese manufacturer of consumer DVD players, under the DVD6C patent license. The arbitral tribunal awarded Toshiba unpaid royalties and interest totaling over $19 million, plus continuing interest at a rate of 2% per month until the award is paid in full. The unpaid royalties consisted of both unreported and underreported royalties due. The arbitral tribunal further ordered that the provision in Coby's license releasing Coby from claims for past patent infringement was null and void, freeing Toshiba to pursue such claims. And the arbitral tribunal awarded Toshiba its full legal fees and costs for the arbitration.

This arbitration is part of a global initiative by the DVD6C Licensing Group to collect unpaid royalties. Toshiba is continuing to pursue arbitration proceedings against several licensees to collect unpaid and underreported royalties under the DVD6C patent license.
